近年来,共享经济的发展给全球经济带来了巨大的变化,共享经济已经成为 人们生活当中的新常态,这种变化不仅对个人的消费交易行为产生了影响,甚至 已经扩展到了一些相关的经济领域当中,越来越多的企业加入了共享经济的运营 队伍之中,甚至这些企业通过“互联网+”所搭建的共享经济平台,为它们在市场 上提供了更加广阔的舞台与发展的空间。共享经济所衍生出的价值与潜力已经逐 步显现。 随着共享经济渗透到各个领域,共享经济时代下劳动关系的特征悄然发生了 变化,新兴了“平台+个人”这种有别于传统劳动方式的新型用工形式。共享经济 平台为劳动者提供了大量就业机会和新的工作模式,在帮助劳动者提升收入水平 的同时,劳动者可以较为自由地安排工作时间。但同时,共享经济的发展对传统 劳动关系秩序产生了巨大挑战。传统劳动法律体系不适应共享经济的发展,劳动 者与共享经济平台的法律关系不明确,平台从业者的劳动权益保护问题应引起重 视。劳动者与企业的关系不再是一种传统的劳动关系,劳动者在新型用工形式所 带来的劳动关系下,劳动权益无法受到应有的保障,企业也无法提前做好防范措 施。笔者通过对X平台从用工管理现状、评分机制及从属性三个方面进行分析,分 析用工关系认定困境、成因,进而建立起一个多方认可的用工关系调整机制,并 提供社会保障、职业安全、经济收入保障等方面的专门保护,对共享经济模式下 的劳资双方、企业与和谐社会的发展不失为一个两全之举。 关键词:共享经济;用工形式;用工关系;调整机制III Table of Contents ABSTRACT.……………………………………………………………………………………….
