摘 要
劳动关系是劳动者与劳动力使用者之间在实现劳动过程中结成的社会经济
利益关系,其和谐与否不仅直接影响企业和劳动者双方利益目标的实现,而且关
系到整个国家的发展和稳定。当前,中国正处于经济转型时期:一方面,市场加
速扩张,经济蓬勃发展,产业升级换代,各类企业面临着创新发展模式的战略机
遇期;另一方面,企业生产方式和管理管理模式的巨大改变、一般劳动力过剩与
高素质人才缺乏的矛盾、各种新的用工形式的产生,这些因素带来的新旧体制摩
擦、利益格局调整、以及法律法规、社会保障体系不够健全等问题,形成了目前
劳动关系中众多不稳定因素,甚至有逐渐增多的趋势。因此,探索新形势下劳动
关系调节机制、实行一系列有针对性的措施是当前构建社会主义和谐社会一项非
常紧迫的任务。

本文以中国经济转型期的劳动关系调节机制为研究主题,通过文献研究与比
较分析等方法,对中国转型期的劳动关系的现状与存在问题进行分析,提出了建
立完善劳动关系调节机制的必要性与迫切性。通过借鉴以德国、日本和美国为代
表的三种不同模式的发达资本主义国家在调整劳动关系方面的理论和成功经验,
为我国政府调节劳动关系提供参考。明确了中国经济转型期的劳动关系调节目标
及调节机制。分别从用工机制完善、保障体系建设、工会作用发挥、法律体系完
善、道德责任建设等方面提出了多条对策建议,以期为政府调节劳动关系,维护
社会稳定,促进社会发展,构建和谐社会提供理论指导。

Abstract
The labor relation is the socio-economic interest relation forged between workers and
labor users in the realization of the labor process. The harmony of the labor relation
not only affects the realization of the interest goals of enterprises and workers but also
relates to the development and stability of the whole country. At present, China is in a
period of economic transformation. On the one hand, due to that the market has
expanded increasingly, the economic has developed greatly and the industry has
upgraded, the various kinds of enterprises are facing the strategic opportunities for the
innovation of development patterns. On the other hand, there are a number of
questions which result in the unstable factors in the labor relation, such as a huge
change in the mode of production and enterprises’ management mode, the
contradiction between the surplus of the general labor and the lack of high-quality
talents, the variety of new forms of employment. The number of the unstable factors
is increasing. Therefore, it is a quite urgent task for building a socialist harmonious
society to explore the adjustment mechanism of labor relations under the new
situation and to implement a series of targeted measures.
This paper would mainly research on the adjustment mechanism of the labor relation
in the situation of China’s economic transformation. It would analyze the current
condition and the problems of China’s labor relation by the literature and comparative
analysis, and then come out the necessary and the urgency to establish and improve
the adjustment mechanism of labor relations. By drawing on theories and successful
experience of the three different models of the developed capitalist countries
(Germany, Japan and the United States) in the adjustment of labor relations, the paper
would provide a reference for our government to regulate labor relations in order to
