摘 要
随着改革开放的深入和市场经济的发展,巨大的人口压力和庞大的市场需求
之间的矛盾,催生了劳务派遣这一行业。这一制度的确立,促进了劳动力的就业,
但是由于法制不健全,导致劳务派遣劳动者权益受到极大损害。这已经成为我们
不得不面对的事实。有鉴于此,文章通过对行业产生理论的阐述,从不同理论视
角看待这一行业的特点。在此基础上,我们总结了国内外劳务派遣行业的不同发
展阶段。通过简单的对比,指出我国劳务派遣存在的不足。我们进而通过对近些
年的劳务派遣员工权益受损案例的搜集,将劳务派遣员工权益受损的主要表现形
式归纳出来。通过总结我们认为问题主要体现在基本服务、工资平等,明确责任
身份认同四个主要方面的缺失。与此同时,我们用整体主义的分析法,从政治,
经济,社会和文化等多角度才分析劳动者权益受损的原因。文章认为法制不健全、
企业贪婪求利、工会无力保护和就业歧视是导致劳务派遣员工权益受损的主要原
因。于是,我们从法制建设、经济发展、社会组织和文化建设四个方面提出相应
的建议。本文拟从被派遣劳动者权益保护普遍缺失的现状出发,通过综合分析法,
比较法,对大量的资料加以分析、归纳,提取具有典型性的资料加以研究。通过
分析我们从以下六个方面入手对保护劳动派遣者权益问题展开论述。

导论部分,本章介绍劳务派遣的研究现状进行介绍和对劳务派遣研究的意义,
并且梳理出本文章的几个关键词的意义并加以分析。

第二章,着重分析劳务派遣行业产生的背景以及现状,总结出劳务派遣这一
行业发展的必要性和存在的优势,进而明确本文研究的现实意义。

第三章,以被派遣劳动者权益保护为基本线索,分析探讨了我国劳务派遣中
劳动者权益保护方面存在的问题及其表现形式,并且通过案例的形式加以分析。

第四章,主要探究劳动者权益受到侵犯的主要原因,文章认为劳务派遣员工
权益受到损害不仅仅是单个因素的堆积,而是一个系统的,整体的制约因素。

第五章,针对上述原因的分析,文章提出一整套的系统的改革措施。认为
需要从经济、政治、法律、社会组织和文件层面去变革才能有效保护劳务派
遣员工的权益。

最后一章为结论,总结全文主要观点,再次阐明本文写作的目的。

With the reform and opening up and development of market economy, the
contradiction between the huge population pressure and huge market demand between
spawned dispatch the industry. The establishment of this system, and promote the
employment of labor, but because the legal system is not perfect, leading to the
dispatch of workers rights have been greatly damaged.This has become a reality we
have to face. In view of this, the article describes the theory generated by the industry
from different theoretical perspectives old look at this industry characteristics.On this
basis, we summarize the different stages of the development of domestic and dispatch
industries. By simple comparison, points out the shortcomings of dispatch exist. We
turn in recent years through the dispatch staff to collect damages the interests of cases,
