随着知识经济的日益发展和国际知识产权保护的加强,知识产权己经成为企业的战略性

资源,能够给企业带来巨大的竞争优势。企业发展自主知识产权最重要的一步就是制定知识

产权战略。但是,我国企业在知识产权战略方面与发达国家企业仍然有一定的差距。因此,

研究我国高新技术企业知识产权战略具有一定的理论和实际意义。

本文在研究过程中运用PEST分析和SWOT分析等方法,对高新技术企业知识产权战略

的内外部环境进行了分析。以知识产权战略理论为基础,以深入分析华为公司的知识产权战

略为目标,从宏观环境、产业环境和企业自身等多方面对华为公司的知识产权战略进行了分

析,发现华为公司在外部环境上,具有法律逐渐完善,政府政策倾斜和通信产业发展迅速的

机遇,但同时也存在信息产业知识产权法律仍不完善,行业标准被国外企业主导和国外市场

存在进入壁垒的威胁。华为公司自身具有专利数量多,技术投入大,公司治理结构先进的优

势,但也存在缺乏核心技术,技术产业化能力不足和知识产权管理能力不足的劣势。接着,

针对性的指出华为公司在知识产权战略方面的建议,认为华为公司应该加强企业研发投入,.

引进技术人才,以市场为导向提高技术产业化能力,并且完善知识产权管理体系。最后,借

鉴华为公司在知识产权战略方面的优势和建议,进一步提出我国高新技术企业应该从提高企

业创新能力,提高知识产权应用能力和建立知识产权管理体系这三方面来改进自身的知识产

权战略,解决了我国高新技术企业的知识产权战略问题,对我国高新技术企业的持续发展有

可借鉴的现实意义。

ABSTRACT

With the development of intellectual economy and the protection of international intellectual

property, intellectual property has become a strategic resource for corporations and can lead to

superiority in competition. The crucial step of the development of independent intellectual property

is intellectual property strategy. However, Chinese corporations have a large gap in intellectual

property strategy with foreign corporations. Therefore, the research of intellectual property strategy

in Chinese high-tech corporations is of great theoretic and practical significance.

In this paper I used PEST analysis methods and comparative analysis methods to analyze the

internal and external environment of intellectual property strategy in high-tech corporations. Based

on the intellectual property strategy theory, I analyzed the intellectual property strategy of Huawei

from macro environment, industrial environment and corporation itself. The analysis demonstrated

that Huawei got the opportunities of improving law, government policy advantage and development

of communication industry. However, it also got the threat of non-perfect law in information industry,

dominance of industrial standards by foreign corporations and entry barriers of foreign market.

Huawei got the strength of large amount of patents, heavy R&D investment and advanced

governance structure and the weakness of lack of core technology, technology industrial ability and

intellectual property management ability. Therefore, the advice for Huawei in intellectual property

strategy is increasing R&D investment, attracting talents, improving technology industrial ability and

intellectual property management structure. At last, take Huawei,s strength and advices in

intellectual property strategy, I proposed that Chinese high-tech corporations should improve their

intellectual property strategy from three aspects which includes technology creative ability,

technology industrial ability and intellectual property management ability and solved the problem of

intellectual property strategy in Chinese high-tech corporations which has a significant reference for

the development of China's high-tech corporations.
