Abstract
Taking the trunk line optical cable maintenance management of Hubei Transmission
Bureau, China Telecom Co. as a sample, and the application of legal means in enterprise
national asset as the angle of view, national asset management of the non-productive
departments in national enterprises was discussed. It is the legal duty of the enterprises,
the practical issue of socialist market economy practice and the enterprises themselves to
enhance national asset management to promote the maintenance and appreciation of
assets in order to avoid any loss. In the background of gradual perfection of socialist
market economy, the enterprises must enhance legal awareness, engage in business
activities according to the laws,learn to guarantee and defend their own legal right,
manage and preserve national asset of enterprises. The key of application of legal means
lies in strictly obey the law, clause of statute, deeply understanding Spirit of Law,
flexibly using disposal modes recognized by laws and clause of statute, selecting the
most economical but practical ways. Though Chinese socialist market economy and law,
clause and statute have gradually perfected, there are still some blind zones and
misdirection. Sometimes legal means cannot reach the anticipated object. Therefore,
legal means are effective though, they are not universal. Only when the enterprises fully
using the legal mean, meanwhile, with the coordination of administrative and economic,
etc., can they better manage national asset.
