D市市医疗中心工程项目合同风险管理研究

摘要
建筑业是我国国民经济发展的重要组成部分，2020年国务院在政府工作报告指出，
重点支持“两新一重（新型基础设施和新型城镇化建设，以及交通、水利等重大工程建
设）”建设，将会使建筑业迎来新的发展。随着市场经济体制改革的深入发展，中国建
筑市场投资主体日趋多元，受国际国内宏观经济风险影响的因素增多，加之工程项目存
在的竞争性加大，项目施工企业面临的风险点不断增加，而合同是工程项目管理的根本
和核心，合同风险管理对项目成败有着重要影响。由于医疗类工程项目的公益性、特殊
性和复杂性，极有必要对此类项目的合同风险管理开展研究。
首先，论文对国内外研究现状进行了分析和综述，梳理了相关的基础理论和相关概
念，在此基础上，论文分析了D市医疗中心工程项目合同风险管理现状，从合同管理架
构、合同体系以及合同风险分担约定方面进行了详细分析。然后，论文综合运用文献分
析法、专家调查法建立了D市医疗中心工程项目合同风险指标体系，并应用层次分析法
确定了各指标的权重。论文基于建立的指标体系，应用模糊综合评判法评价了D市医疗
中心工程项目合同风险并进行了结果分析。最后，论文基于评价结果给出了D市医疗中
心工程项目合同风险管理改善方案。
论文对D市医疗中心工程项目合同风险管理以及工程项目的顺利开展具有重要实践
价值，同时在细分层面进一步丰富了合同风险管理理论，特别是对探讨医疗类工程项目
合同风险管理提供了更多的理论思考和实践。

ABSTRACT
The construction industry is an important part of the development of China's national
economy. The State Council pointed out in the Government Work Report of 2020 that the
construction of "two new types and one key project (new-type infrastructure and new-type
urbanization construction, as well as transportation, water conservancy and other major
projects)" will be supported, which will usher in new development of the construction
industry.With the further development of the reform of the market economy system, the
investment subjects in China's construction market are increasingly diversified. And the
number of factors affected by the internationaland domestic macroeconomic risks are
increasing. In addition, the competitiveness of the projects is increasing. Therefore, the project
construction enterprises are faced with increasing risks. And contract is the fundamental and
core of project management. Contract risk management has an important impact on the success
or failure of the project. Because of the public welfare, particularity and complexity of medical
engineering projects, it is necessary to study the contract risk management of such projects.
First of all, this paper analyzes and summarizes the current research situation at home and
abroad, and sorts out the relevant basic theories and concepts. On this basis, this paper analyzes
the current situation of contract risk management of medical center engineering project in D
City, and makes a detailed analysis from the aspects of contract management framework,
contract system and contract risk sharing agreement. Then, the paper establishes the contract
risk index system of medical center project in D city by comprehensive use of literature
analysis method and expert investigation method, and determines the weight of each index by
using analytic hierarchy process. Based on the established index system, the paper uses the
fuzzy comprehensive evaluation method to evaluate the contract risk of the medical center
project in D city and analyzes the results. Finally, based on the evaluation results, the paper

gives an improvement plan for the contract risk management of the medical center engineering
project in D City.
This paper has important practical value for the contract risk management of the medical
center engineering project in D city and the smooth development of the project. At the same
time, it further enriches the theory of contract risk management at the level of subdivision,
especially provides more theoretical thinking and practice for the discussion of the contract risk
management of medical engineering projects.
