劳务派遣作为一种新型的企业用工形式,受到越来越多企业的青睐。它是一
种突破传统单纯的双方劳动关系,而转变为三方主体的特殊用工类型,即包括劳
务派遣机构、实际用工单位以及劳动者个人。其中,劳务派遣公司与劳动者形成
法律上的劳动关系,签订书面的劳动合同,并受到劳动法以及相关法律法规的约
束;而劳务派遣公司并不实际用人,而将劳动者派遣至用工单位,并依照双方签
订的劳务派遣合作协议,享有权利并承担相应的义务;同时,劳动者与实际用工
单位不存在法律上规定的劳动关系,劳动者仅仅为用工单位提供实际劳动力,双
方权利、义务不受劳动法调整。实践中多因其具有用工灵活、成本较低等特点而
被企业釆用。
正是因为打破了传统的仅有双方便形成的简单劳动关系,使其在实际应用过
程中也出现了不同于以往劳动关系所具有的利与弊,给企业人力资源管理带来新
的挑战。
内蒙古伊泰集团在企业战略和业务转型的关键时期,开始引进劳务派遣这一
用工方式。本研究试图从企业用工实际出发,全面分析劳务派遣管理过程中遇到
的问题,寻找出行之有效的解决问题的方法及对策,为公司劳务派遣相关管理的
发展提供一种科学、有效的评价标准,为进一步规范企业整体用工提供参考。

Abstract
Labor dispatch as a new corporate form of employment, more and more enterprises
favor. It is a breakthrough of traditional labor relationship between both parties, and into
three parties special employment types, including labor sending agencies,the accepting
unit and individual workers. Among them, the labor dispatch company and laborers who
form a legal labor relationship, a written labor contact, and labor law and related laws
and regulations restraint; and dispatch company labor is not practical for people,and
will send workers to labor units, and in accordance with the two sides signed the labor
dispatch agreement,enjoy the rights and assume corresponding obligations; at the same
time,there is no legal provisions of the labor relations between employers and the actual
labor units,workers provide only the actual labor employment units,the rights,
obligations are not adjusted by the labor law. Practice more flexible with employment,
low cost and used by the enterprise.
Because only the two sides will break the traditional form of simple labor relations,
making it in the practical application process, also appeared the different advantages
and disadvantages in the labor relationship with the former, which brings new
challenges to the enterprise human resources management.
Inner Mongolia Yitai group key period of transformation in the enterprise strategy
and business began to introduce the labor dispatch method. This study attempts to
enterprise reality, a comprehensive analysis of the labor dispatching management
encountered problems in the process of finding a solution to the problem, methods and
Countermeasures for effective,provides a scientific,effective evaluation standard
development for the company to dispatch management, to provide reference for further
standardize enterprise employment.
